Damon Dash is suing Lee Daniels for five million dollars for breach of contract over the Richard Pryor biopic. Dash claims that Daniels never intended to give him a co-executive producing credit for a planned Richard Pryor biopic, despite agreeing to do so.

The lawsuit was filed Tuesday and Dame states he was scammed out of a credit and the 5% of backend profits that he was promised before Daniels ditched the project. Dash said he was never informed of the movie’s progress and Daniels never “made any commercially reasonable efforts to obtain the EP consideration,” according to the lawsuit which is requesting compensatory damages of $5 million.

The music producer also posted a video on Instagram Tuesday of a confrontation with Daniels in which he threatened to go public with another lawsuit.

Dash previously sued Daniels for $25 million in 2014, claiming that he had loaned the producer $2 million for rights to certain projects, including “Precious,” “Butler” and “Empire,” but never saw a dime back or the ownership rights.
